Keurig K-Cup Recyclability Lawsuit Update

A proposed class action accuses Keurig Dr Pepper of misleading consumers by labeling its single-use K-Cup beverage pods as "recyclable," even though most people allegedly can't actually recycle them. According to the complaint, most U.S. recycling facilities won't accept K-Cups because of their small size, odd shape, mixed materials, contamination problems, and poor economics for recyclers. The suit claims these practices violate Florida's Deceptive and Unfair Trade Practices Act along with federal consumer protection laws. On May 5, 2026, an amended complaint added Keurig Green Mountain, Inc. as a defendant. Keurig has since pushed back, filing a Motion to Dismiss the amended complaint and a Motion to Strike the class allegations on June 2, 2026. Notably, this marks the third time Keurig has faced legal action over the same recyclability claims: the company previously paid $10 million to settle a class action in 2022 and resolved a related SEC enforcement action in 2024. No settlement has been reached in this case, and no money is currently available to consumers.
