What this settlement is about
Between October 5, 2024, and October 6, 2024, an unauthorized person allegedly accessed Drug and Alcohol Treatment Services (DATS) systems containing sensitive protected health information, including names, addresses, dates of birth, Social Security numbers, health insurance details, patient account numbers, medication records, diagnosis and treatment information, doctors' names, and medical claims and billing data. DATS denies any wrongdoing, and no court has ruled on the claims. To avoid the expense and risk of continued litigation, both sides reached a proposed settlement, which is now awaiting court approval, with a Final Approval Hearing scheduled for November 24, 2026. Class members can choose between two payment options: up to $5,000 for documented out-of-pocket expenses, which requires supporting proof, or a flat alternate cash payment that needs no proof but may be adjusted up or down depending on the total number of claims filed. Either way, class members can also request one year of free medical identity theft monitoring through CyEx.
