Case overview
What this settlement is about
A class action accuses Festival Fun Parks, LLC, doing business as Palace Entertainment, of not properly disclosing a processing fee tacked onto electronic tickets for the Splish Splash waterpark before customers chose their tickets online — allegedly violating New York Arts and Cultural Affairs Law § 25.07(4). Palace Entertainment denies doing anything wrong.
To resolve the case, the company has agreed to a $1,000,000 settlement fund. The matter is being handled in court rather than arbitration, and it hasn't been finally resolved yet.
Eligible customers can submit a claim for payment, which will be paid out pro rata among everyone who's approved. Filing requires the unique ID and PIN sent in your settlement notice.
Keep in mind that payments will only go out once the court gives final approval and any appeals are settled.
